Terms of Service

These Terms of Service ("Terms") govern your use of the Easy-Case bankruptcy petition preparation platform at easy-case.com (the "Service"), operated by Easy-Case, Inc. ("Easy-Case," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and a resident of the United States to use the Service. Bankruptcy petitions may only be filed by individuals who meet the eligibility requirements of the United States Bankruptcy Code (Title 11, U.S.C.). Easy-Case includes a free eligibility screener but does not make legal determinations about your right to file.

2. What Easy-Case Does & Does Not Do

What We Do

• Provide a guided interview that collects the information required for bankruptcy petition forms
• Generate completed Official Bankruptcy Forms based on your answers
• Calculate your means test using current IRS and Census Bureau allowance data
• Suggest applicable exemptions based on your state of residence
• Calculate Chapter 13 repayment plan amounts when applicable
• Extract data from uploaded documents (pay stubs, tax returns, bank statements) to reduce manual entry
• Provide district-specific filing instructions, court addresses, and local form requirements
• Provide educational information about the bankruptcy process

What We Do Not Do

You are filing "pro se" (on your own behalf). All decisions about your bankruptcy case are yours alone. If you need legal advice, we encourage you to consult a licensed bankruptcy attorney.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and complete information when creating your account and to keep it up to date. You must notify us immediately if you suspect unauthorized access to your account.

Each account is for a single individual. You may not share your account or create multiple accounts for the same bankruptcy case.

4. Payment & Refunds

Easy-Case is free for simple Chapter 7 cases, $49 for Professional features (AI help, document scanning, complex filings), and $99 for Chapter 13 cases. These fees cover the preparation of all required Official Bankruptcy Forms, means test calculations, exemption suggestions, and filing instructions for your district.

The service fee does not include the court filing fee, which is paid directly to the bankruptcy court. Court filing fees are currently $338 for Chapter 7 and $313 for Chapter 13. Low-income filers may qualify for a fee waiver or installment plan — Easy-Case will help you determine eligibility and prepare the application if applicable.

Payment is processed securely by Stripe. We accept major credit and debit cards.

Refund Policy

If you are unsatisfied with the Service or if the Service is unable to generate your forms for any reason, you may request a full refund within 30 days of payment. Contact support@easy-case.com to request a refund. Refunds are processed to your original payment method within 5-10 business days.

5. Your Content & Data

You retain ownership of all information and documents you provide to the Service ("Your Content"). By using the Service, you grant us a limited license to use Your Content solely to provide the Service to you — that is, to process your information, generate your bankruptcy forms, and operate the platform.

We do not claim ownership of Your Content. We do not use Your Content to train machine learning models. We do not sell Your Content to third parties. See our Privacy Policy for full details on how we handle your data.

6. Accuracy of Information

The accuracy of your bankruptcy petition depends on the accuracy of the information you provide. You are solely responsible for ensuring that all information entered into the Service is truthful, complete, and current. Bankruptcy petitions are signed under penalty of perjury (28 U.S.C. §1746), and providing false information to a bankruptcy court is a federal crime (18 U.S.C. §152).

While Easy-Case includes validation checks and warnings to help catch common errors, we cannot verify the truthfulness of the information you provide. You should review all generated forms carefully before filing.

7. Intellectual Property

The Service, including its design, software, text, graphics, and logos, is owned by Easy-Case and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

The bankruptcy forms generated by the Service are based on Official Bankruptcy Forms published by the Administrative Office of the United States Courts, which are public domain. Your completed forms belong to you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASY-CASE'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

IN NO EVENT SHALL EASY-CASE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless Easy-Case, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) inaccurate or incomplete information you provide, or (d) your bankruptcy filing or any related legal proceedings.

11. Termination

You may close your account at any time by contacting us at support@easy-case.com. We may suspend or terminate your account if you violate these Terms, if we are required to do so by law, or if we discontinue the Service.

Upon termination, your right to use the Service ceases. We will retain your data in accordance with our Privacy Policy and applicable law.

12. Disputes & Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Cook County, Illinois.

Before filing a formal dispute, you agree to contact us at support@easy-case.com and attempt to resolve the matter informally for at least 30 days.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
